Former Federal Court judge Marcus Einfield’s appeal against his sentence of three years’ imprisonment  for perjury and perverting the course of justice has failed.

Justice Basten ruled that 71-year-old Einfeld’s sentence should be reduced to 18 months non-parole but Justices Latham and Hulme dismissed the appeal.

Einfeld, whose lawyers claim suffers from a bi-polar disorder, was found guilty last year of  perjury following a road traffic incident in which a speed camera clocked his car 10kph over the limit in the Sydney suburb of Mosman. Einfeld lied to the authorities claiming that he was not the driver and naming an overseas deceased person as being at the wheel.

Einfeld will remain in prison until March next year.
